Local Authority Statutory Duties

These are the statutory duties which the London Borough of Hillingdon (Hillingdon Council) has contracted out to the Governor Support Service from April 2017 to the end of March 2018. The Governor Support Service will deliver these functions to maintained schools in Hillingdon.

Advice and guidance to schools requiring a legal change to their formal constitution (Instrument of government).

All maintained schools must have a governing body constituted under the 2012 regulations by 01 September 2015. A governing body or the LA may vary a governing body’s constitution at any time thereafter under these regulations. Governing bodies are required by the DfE statutory constitution guidance to review their constitution from time to time to ensure it meets the schools needs and is fit for purpose.

We review each draft Instrument of Government (IOG) for statutory compliance, and check that the governing body has formally agreed any new constitution as per the regulations. We will then facilitate the formal approval by the LA for each IOG. We also support schools with advice and guidance, before, during, and after reconstitution to ensure governing body membership meets statutory regulations in terms of membership appointments and elections affected by changing the constitution.

Procedures, advice and guidance to community and voluntary controlled schools on parent governor elections.

Legal reference: The School Governance (Constitution) (England) Regulations 2012, SCHEDULE 1, Election and appointment of parent governors

The LA is the appropriate authority for maintained community and voluntary controlled schools. The LA must set the procedures and publish these to the appropriate schools.

We provide advice and guidance (telephone, email, and in person where required) on the current LA procedures published to schools through the this website. We will troubleshoot where there are conflicts and challenges raised by schools concerning elections.

Recruitment and nomination of Local Authority (LA) governors.

Legal reference: The School Governance (Constitution) (England) Regulations 2012, PART 2, Local authority governor, Regulation 8

LA governors are nominated by the LA for formal appointment by the governing body. The nominated governor must, in the opinion of the governing body, meet any eligibility criteria that they have set to the LA. A process must therefore be in place to recruit suitably skilled individuals for nomination.

We will provide advice and guidance (telephone, email, and in person where required) on the current LA procedures published to schools through our own GSS website. We maintain records of LA governors in maintained schools in Hillingdon, along with their terms of office. Schools with an LA governor vacancy will be reminded to submit the skills they are seeking from a future LA governor candidate. We will then be able to seek suitable nominees for the LA to nominate and facilitate that process.

School Governor Application Form 2017

Removal of Local Authority (LA) governors.

Legal reference: The School Governance (Constitution) (England) Regulations 2012, PART 4 Removal of local authority governors Regulation 22

Any local authority governor may be removed from office by the local authority who nominated the local authority governor under regulation 8(a). The local authority must give written notice of the removal from office to the clerk to the governing body and to the local authority governor who is being removed.

We provide advice and guidance (telephone, email, and in person where required) to schools and the LA where an LA governor is giving cause for concern and the governing body has sought their removal from the board.

Information given to new governors by the Local Authority

When a maintained school governor is appointed, they should receive background information from the local authority.

We will issue a new governor pack by email to each new governor when we are notified of their appointment by the clerk to governors. This pack is updated annually to reflect current national and local policy and practice.

Information from the governing body to the Local Authority

Legal references: Section 30 of the Education Act 2002

The governing body of a maintained school must give the local authority any relevant information or reports in connection with the discharge of the governing body’s functions that the local authority may need.

The practice standard is for LAs to maintain a database of maintained schools with, as the minimum, contact details for the Chair of Governors and Clerk. Recording of names and categories of all other governors, including vacancies, are also requested in order to effectively identify and manage the nomination process for any vacant LA or other governor posts. Clerks are responsible for supplying this information upon GSS/LA request.

We hold a database of maintained school governing bodies on behalf of the LA. Such information is needed for governor recruitment purposes, in cases of urgency, safeguarding, Ofsted inspections, and schools where there is a cause for concern. All data is stored and accessed in accordance with the Data Protection Act. The only piece of information we can give out publically is the name of the Chair of the Governing Body, which is already in the public domain. We do not give out personal contact details or any other information.
